Heck with IE7. anyone still using it, can suffer the consequences of not updating. IE8 isn’t bad at all for compatibility. minor nuances but nothing more and nothing to bawl about.

the tag could replace div #comments, but div .comment still has no semantics in HTML 5. the lack of is definitely the biggest fail for HTML 5

That’s fine if you’re using PHP, but not if you’re writing plain HTML or using another web programming language that might not have that feature.
